Legitimate Interests - where the processing is necessary for the legitimate interests of your business (e.g. direct marketing (which is listed) to a list of people about your services). however, have to balance if there are reasons to protect that individuals data that override legitimate interests. should go through a considered process
consent - "a clear and affirmative act". can't have opt-out, has to be opt-in. no more pre-ticked boxes. giving you genuine choice and control. need a positive action.

The idea is relatively simple: cookies can be used to uniquely identify a person, therefore they should be treated as personal data. It will affect those identifiers used for analytics, advertising, but also those used for functional services like chats and surveys. The users must have a choice. The fact that they use a website does not mean they agree to all cookies. Like all other consent under the GDPR, consenting to cookies needs to be a clear affirmative action. when cookies can identify an individual via their device, it is considered personal data. Not all cookies are used in a way that could identify users, but the majority are and will be subject to the GDPR. This includes cookies for analytics, advertising and functional services, such as survey and chat tools.

Clear Gifs (Web Beacons/Web Bugs)
We employ a software technology called clear gifs (a.k.a. Web Beacons/Web Bugs), that help us better manage the Website and Subscription Service by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored on a user's computer hard drive, clear gifs are embedded invisibly on Web pages or in emails and are about the size of the period at the end of this sentence. We use clear gifs in our HTML-based emails to let us know which emails have been opened by recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns. 3rd Parties
social media marketing - when the data is on their platform, they are in charge of it, they are the processing, so *they* need to have got the lawful ground of processing themselves. this should be governed by linkedin, or facebooks policies. where it becomes difficult is where you take data off the platform and do things with it, or upload your data e.g. a custom audience - then you are the data controller. should be able to rely on legitimate interests group for facebook advertising and would not need consent. don't need 'click here so we can advertise to you'. BUT it must be in your privacy notice. should also allow people to opt-out of your custom audiences (as well as your email).

We obtain additional information about you from third party sources, such as APIHub, Inc, to enrich your experience on the segment.com website and provide you with more relevant information related to our service offerings.
